1. Who We Are / Scope

This Privacy Policy explains how Holzkern U.S. Inc. ("Holzkern," "we," "us"), 1 Penn Plaza, Suite 4440, New York, NY 10119, collects, uses, and discloses personal information of U.S.-resident visitors and customers of https://us.holzkern.com (the "Site").

Our operations — marketing, customer support, order and logistics coordination, and payment reconciliation — are performed on our behalf by our affiliate Time for Nature GmbH in Vienna, Austria. As a result, your personal information is processed in the European Union under EU data-protection standards (GDPR), which provide a high level of protection. See Section 11.

2. Personal Information We Collect

In the past 12 months we have collected the following categories of personal information (as defined under the California Consumer Privacy Act, "CCPA"):

  • Identifiers: name, email, phone, shipping/billing address, order/account IDs, IP address, online identifiers/cookie IDs.

  • Commercial information: products purchased or viewed, order history, returns.

  • Internet/network activity: interactions with the Site, pages viewed, referring pages, device/browser data.

  • Geolocation data: approximate location derived from IP (city/region level).

  • Customer-service content: messages you send us (chat, email, forms).

  • Payment information: processed by our payment providers; we receive confirmation, not full card numbers.

We do not knowingly collect Social Security numbers, precise geolocation, or other categories of "sensitive personal information" for the purpose of inferring characteristics.

3. Sources

Directly from you (orders, account, forms, chat); automatically via cookies and similar technologies; and from our service providers (payment, shipping, analytics).

4. How We Use Personal Information

To process and deliver orders; provide customer service and warranty/returns handling; operate, secure, and improve the Site; prevent fraud; conduct analytics and market research; send service messages; and — where permitted — send marketing and show relevant advertising.

5. How We Disclose Personal Information

We disclose personal information to:

  • Service providers / processors who act on our behalf under contract, including: Shopify (store platform), Google Cloud (hosting/data infrastructure), Klaviyo and Brevo (email/SMS), Gorgias, Freshdesk and Digital Genius (customer support), AfterShip (shipment tracking), Rivo (loyalty), KNO Commerce (surveys), Trusted Shops (reviews), Consentmo (consent management), and payment processors (Shopify Payments / Shop Pay, PayPal, Google Pay / Apple Pay).

  • Analytics providers: Google Analytics 4, Google Tag Manager, Microsoft Clarity, Klar Insights, Kameleoon.

  • Advertising partners for cross-context behavioral advertising: Meta (Facebook/Instagram), Google Ads, Criteo, Pinterest, and Microsoft Advertising.

  • Others where required by law, to protect our rights, or in a corporate transaction.

6. "Sale" and "Sharing" of Personal Information; Your Opt-Out

Under the CCPA, our use of advertising cookies/pixels (Section 5) that enable cross-context behavioral advertising may be considered "sharing" and/or a "sale" of personal information (identifiers and internet-activity data), even though no money is exchanged. We do not sell or share the personal information of consumers we know to be under 16 without opt-in consent.

You have the right to opt out. You can use our "Do Not Sell or Share My Personal Information" link / cookie-preferences control on the Site, and enable a Global Privacy Control (GPC) signal in your browser, which we honor for the browser/device on which it is enabled.

7. Your Privacy Rights

Depending on your state of residence, you may have the right to: know/access the personal information we hold; delete it; correct it; opt out of "sale"/"sharing" and of targeted advertising; limit the use of sensitive personal information; obtain a portable copy; and not be discriminated against for exercising these rights. Residents of some states may also appeal a denied request.

8. How to Exercise Your Rights

Submit a request by emailing hello@holzkern.com. We will verify your identity before responding. You may use an authorized agent, subject to verification. We will respond within the timeframes required by applicable law.

9. Cookies and Tracking

We use cookies and similar technologies for essential Site functions, analytics, and advertising. You can manage non-essential cookies through our consent tool (Consentmo) and your browser settings; we honor recognized opt-out preference signals (GPC). See Section 6 for advertising opt-out.

10. Data Retention

We keep personal information only as long as needed for the purposes described here and to meet legal, tax, accounting, and dispute-resolution obligations, after which we delete or de-identify it.

11. International Processing

Your personal information is processed by our affiliate in Austria (EU) and stored on servers in the EU. Where any onward transfer from the EU to the U.S. or another country occurs through our service providers, appropriate safeguards (such as the EU-US Data Privacy Framework or Standard Contractual Clauses) are applied to those transfers. Processing your data in the EU means it is handled under GDPR-level protections.

12. Children

The Site is not directed to children under 13, and we do not knowingly collect their personal information. We do not sell or share personal information of consumers under 16 without opt-in consent.

13. Changes

We may update this Policy; changes are effective when posted with a new "Last Updated" date.
