1. Who We Are
These Terms of Service ("Terms") govern your purchase of products and your use of the website at https://us.holzkern.com and related pages (the "Site"). Your contract of sale is with:

Certain operational services (marketing, customer support, order and logistics coordination, and payment reconciliation) are performed on our behalf by our affiliate Time for Nature GmbH (Vienna, Austria). Holzkern U.S. Inc. remains the seller and your contracting party.
By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to purchase from us. By ordering, you represent that you meet these requirements and that the information you provide is accurate.
3. Your Account
You may order as a guest or create an account. You are responsible for keeping your credentials confidential and for all activity under your account. Please notify us promptly of any unauthorized use.
4. Products, Pricing, and Availability
4.1. All prices are stated in U.S. dollars. Applicable sales/use tax is calculated and added at checkout based on your shipping destination. Shipping charges, if any, are shown before you complete your order.
4.2. We make reasonable efforts to display products and prices accurately, but errors may occur. We reserve the right to correct errors and to change prices, products, and promotions at any time before your order is accepted.
4.3. Product images are for illustration. Because our products use natural materials, slight variations in color and grain are normal and are not defects.
4.4. All content on the Site (text, graphics, images, logos, designs) is owned by or licensed to Holzkern and is protected by U.S. and international intellectual-property laws. You may not copy, reproduce, or commercially use it without our prior written consent.
5. Orders and Acceptance
5.1. Your order is an offer to purchase. A binding contract is formed only when we accept your order by dispatching the products. Our order-confirmation email acknowledges receipt but does not by itself constitute acceptance.
5.2. We may refuse, limit, or cancel any order at our discretion, including where we suspect fraud, ordering errors, pricing errors, or resale.
5.3. If we cancel an order after payment, we will refund the amount charged for the cancelled items.
6. Payment
We accept the payment methods shown at checkout, which currently include Shopify Payments (card payments and Shop Pay) and digital wallets such as Google Pay and Apple Pay, as well as PayPal. By providing a payment method, you authorize us and our payment processors to charge the total order amount, including tax and shipping. Payment-processor terms and privacy policies apply to their handling of your payment data. We do not store full card numbers.
7. Shipping and Delivery
Shipping options, delivery estimates, and any fees are described in our Shipping Policy, which is incorporated into these Terms. Delivery time estimates are not guaranteed. Title and risk of loss pass to you upon delivery of the products to the carrier; we will nonetheless assist with claims for items lost or damaged in transit.
8. Returns and Refunds
There is no statutory cancellation right for online purchases in the United States. Returns are offered voluntarily under our Return Policy, which is incorporated into these Terms. In summary: returns are accepted within the stated return window; return shipping is free for Premium Club members and otherwise subject to a return-shipping fee.
9. Limited Warranty and Disclaimer
9.1. Holzkern provides a voluntary Limited Warranty as described in our Warranty Policy (incorporated into these Terms).
9.2. Except for the express Limited Warranty, and to the fullest extent permitted by law, the products and the Site are provided "as is" and "as available," and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow the exclusion of certain implied warranties, so parts of this disclaimer may not apply to you.
10. Limitation of Liability
To the fullest extent permitted by law, Holzkern and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g., personal injury caused by our negligence or product liability).
11. Indemnification
You agree to indemnify and hold harmless Holzkern and its affiliates from claims arising out of your breach of these Terms or your misuse of the Site or products, to the extent permitted by law.
12. Promotions and Discount Codes
Discount codes and promotional vouchers are issued at our discretion, are non-transferable unless stated, cannot be combined with other offers unless stated, have no cash value, and are valid only for the stated period and conditions. Already-reduced items may be excluded. We may cancel or refuse codes obtained or used in violation of their terms.
13. Prohibited Use
You agree not to use the Site unlawfully, interfere with its operation, scrape or copy content, or infringe the rights of others.
14. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted with an updated "Last Updated" date; for material changes we will provide reasonable notice. Your continued use after changes take effect constitutes acceptance.
15. Governing Law and Dispute Resolution
15.1. These Terms and any dispute arising from them or your purchase are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-laws rules. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
15.2. Before filing a claim, you agree to contact us at hello@holzkern.com and attempt to resolve the dispute informally for at least 30 days.
15.3. Any dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring qualifying claims in small-claims court.
15.4. Disputes will be arbitrated only on an individual basis; you and Holzkern waive any right to participate in a class, collective, or representative action.
15.5. You may opt out of this arbitration agreement by emailing hello@holzkern.com within 30 days of first accepting these Terms.
16. General
16.1. If any provision is held unenforceable, the remaining provisions stay in effect.
16.2. These Terms, together with the Shipping, Return, Warranty, and Privacy policies incorporated by reference, are the entire agreement between you and Holzkern regarding your purchase.
16.3. You may not assign your rights under these Tems without our consent; we may assign ours to an affiliate or successor.
16.4. Our failure to enforce a provision is not a waiver.
16.5. We are not liable for delays or failures caused by events beyond our reasonable control.
